Announcement of the public consultation on the Rules of operation of liquefied natural gas terminal

Invitation to participate in public consultation in the period from 25 June  to 9 July, 2021

Zagreb, 24 June 2021 – LNG Croatia LLC., as a terminal operator, informs the interested public about the beginning of the public consultation on the Proposal of the Rules of operation of liquefied natural gas terminal. We are taking this opportunity to invite all energy subjects together with all interested public to submit their comments and opinions through the consultation form by 9 July 2021 at the latest. Public consultation will be open from 25 June  to 9 July, 2021.

The Terminal began operations on 1 January 2021. After the first quarter of the Terminal’s commercial operation, it was noticed that the valid text of the Rules had to be adjusted to the new circumstances.

Among the more significant amendments, we would like to point out amendments in the capacity booking procedure, with the aim of simplifying the booking procedure on the one hand, and protecting the interests of the Terminal Operator on the other.

In addition, there was a need to nomotechnically refine the current wording of certain provisions so that the provisions are understandable, unambiguous and clear to Terminal Users and all other addressees, all for the purpose of improvement and more efficient implementation.

A chapter of the Rules entitled “LNG redischarge from the Floating LNG Storage and Regasification Unit into the LNG carrier or LNG transport truck” was added, prescribing the manner of using these non-standard services of the Terminal, and regulating in detail the mutual rights and obligations of the users of these services and the Terminal Operator.

Furthermore, the Natural Gas Allocation Policy, which sets out the principles of calculation of natural gas available at the Terminal, has been moved to a separate document that will be published by LNG Hrvatska d.o.o. on its website, while the basic rules and principles of the the Natural Gas Allocation Policy are now set out in the text of the Rules themselves.

In addition to the above, we wish to point out that the adoption of the Rules from 2018 was followed by two more amendments to the Rules in 2020, and that these amendments changed more than half of the Rules’ provisions. In view of the above, it is not sufficient to adopt amendments of the existing Rules; instead, it is necessary to adopt new Rules.

The proposed amendments were made in accordance with transparent, non-discriminatory and market-focused EU practices and rules so as to enable access to interested users under equal conditions.

ANNOUNCEMENT OF THE PUBLIC CONSULTATION ON THE AMENDMENTS OF THE RULES OF OPERATION OF LIQUEFIED NATURAL GAS TERMINAL

INVITATION TO PARTICIPATE IN PUBLIC CONSULTATION in the period from November 13 to November 27, 2020

LNG Croatia LLC., as a terminal operator, informs the interested public about the beginning of the public consultation on the Proposal of the amendments of the Rules of operation of liquefied natural gas terminal. We are taking this opportunity to invite all energy subjects together with all interested public to submit their comments and opinions through the consultation form by 27 November 2020 at the latest. Public consultation will be open from November 13 to November 27, 2020.

In accordance with inquiries from interested suppliers and gas traders for LNG acceptance and dispatch services, i.e. the possibility of annual contracting of terminal capacity in case of free capacity, and in accordance with inquiries and comments of Terminal users after concluding Terminal Use Agreements, with which the operator coordinated further necessary amendments to these Rules, individual amendments were made to articles related to LNG and LNG regasification capacity trading, as well as the development of annual and monthly service schedules. 

The proposed amendments were made in accordance with transparent, non-discriminatory and market-focused EU practices and rules so as to enable access to interested users under equal conditions.  

Following all the above, the following is a brief explanation and description of the main changes in the articles and annexes of the Proposal for Amendments to Rules of operation of the liquefied natural gas terminal.

Zagreb, 10 December 2020 – LNG Croatia LLC, as an LNG Terminal Operator, after completing the public consultation on the Proposal of the amendments of the rules of operation of liquified natural gas terminal, has modified the document according to the comments received and, in accordance with the Gas Market Act (Official Gazette, No. 18/18 and 23/20), obtained approval from the Croatian Energy Regulatory Agency. Rules on the amendments of the rules of operation of liquified natural gas terminal (Official Gazette, No. 136/20) were adopted and published in the Official Gazette on 9 December 2020 and shall enter into force on 10 December 2020.

RULES ON THE AMENDMENTS OF THE RULES OF OPERATION OF LIQUIFIED NATURAL GAS TERMINAL HAVE BEEN ADOPTED

Zagreb, 2 April 2020 – LNG Croatia LLC, as an LNG Terminal Operator, after completing the public consultation on the Proposal of the amendments of the rules of operation of liquified natural gas terminal, has modified the document according to the comments received and, in accordance with the Gas Market Act (Official Gazette, No. 18/18), obtained approval from the Croatian Energy Regulatory Agency. Rules on the amendments of the rules of operation of liquified natural gas terminal (Official Gazette, No. 39/20) were adopted and published in the Official Gazette on 1 April 2020 and shall enter into force on 2 April 2020.

ANNOUNCEMENT OF THE PUBLIC CONSULTATION ON THE AMENDMENTS OF THE RULES OF OPERATION OF LIQUEFIED NATURAL GAS TERMINAL

INVITATION TO PARTICIPATE IN PUBLIC CONSULTATION in the period from March 6 to March 23, 2020

LNG Croatia LLC, as a terminal operator, informs the interested public about the beginning of the public consultation on the Proposal of the amendments of the Rules of operation of liquefied natural gas terminal. We are taking this opportunity to invite all energy subjects together with all interested public to submit their comments and opinions through the consultation form by 23 March 2020 at the latest. Public consultation will be open from March 6 to March 23, 2020.

In accordance with the inquiries from gas suppliers and traders interested in LNG regasification service, i.e. the possibility of annual capacity booking in case of available capacity at the terminal, some amendments have been made to articles related to the annual capacity booking procedure with the purpose of necessary procedural steps clarification, simplification of the capacity allocation process itself and extension of the deadlines for requests submission.

The proposed amendments are made in line with transparent, non-discriminatory and market-oriented EU practices and rules to allow all interested users access by equal rules. The proposed amendments to the existing Rules of operation of liquefied natural gas terminal are explained in more detail in the Amendments Explanations document.

THE SECOND ROUND OF THE OPEN SEASON PROCEDURE IS CLOSED

Zagreb, December 21, 2018 – Until the deadline for submission of bids in the second round of the Open Season procedure for contracting the terminal regasification capacities which was on 20th December 2018, LNG Croatia received bids for binding capacities booking of the terminal in the amount of 0.52 billion cubic meters. In addition to the offers for binding capacities booking, conditional bids for non-binding capacity booking in the amount of 0.3 billion cubic meters were received.

In accordance with the Rules for carrying out the binding phase of the Open Season procedure, the analysis of the economic test based on the received bids will be conducted. An economic test is a tool that allows estimating the profitability of the project in different scenarios. Depending on the results of the economic test, a decision on possible scenario for LNG terminal realization will be taken. Upon completion of the economic test, potential terminal users and all interested public will be informed.

DEADLINE FOR CLOSING THE SECOND ROUND OF THE OPEN SEASON PROCEDURE IS BEING PROLONGED

LNG Croatia is taking this opportunity to inform all interested companies that the deadline for closing the second round of the Open Season procedure is being prolonged from 28th September 2018 to 20th December 2018.

Since LNG Croatia has received additional requests from interested terminal users to extend the submission deadline, LNG Croatia in cooperation with Plinacro and FGSZ aligned a new time schedule for the Open Season procedure.

New time schedule for the Open Season procedure execution will be sent to all registered applicants.

DEADLINE FOR CLOSING THE OPEN SEASON SECOND ROUND IS PROLONGED

LNG Croatia is taking this opportunity to inform interested companies that the deadline for closing the Open Season second round is being prolonged.

As initially planned, deadline for closing the second round of the Open Season procedure is 3 August 2018. Since LNG Croatia received requests from interested terminal users to extend the submission deadline, LNG Croatia in cooperation with Plinacro and FGSZ aligned a new time plan for the completing of the Open Season procedure.

Considering that interested terminal users are still in the negotiations procedure with potential LNG suppliers and that finalizing negotiations about LNG supply is key for finalizing binding offers which LNG Croatia expects as a result of the Open Season second round, deadline for the binding offers submission will be September 28, 2018.

CALL FOR THE SUBMISSION OF BINDING OFFERS IN THE SECOND ROUND OF THE OPEN SEASON PROCEDURE

In accordance with the earlier announcement and following the market circumstances and requirements of the potential terminal users, the second round of binding phase of the Open Season process was postponed from April 23 to June 22, 2018. We are taking this opportunity to inform all the interested companies that the second round is officially opened and that the deadline for offer submission is August 3, 2018 in accordance with the Rulebook.

All registered applicants will receive the newest version of Rulebook together with the associated annexes. We are taking this opportunity to inform all the interested energy entities to register in order to receive the documentation and to participate in the Open Season process.

We are reminding all the potential users that LNG Croatia and Plinacro (transmission system operator) want to realize the LNG Project together, which includes the construction of the LNG terminal on the island of Krk together with the connecting gas pipeline. LNG Croatia has aligned the Open Season procedure as well as the time schedule with the Open Season procedure of Plinacro for the transmission system capacity booking.

NEW RULES OF OPERATION OF LIQUEFIED NATURAL GAS TERMINAL HAVE BEEN ADOPTED

Following the public consultation on the Proposal of the rules of operation of liquified natural gas terminal, LNG Croatia LLC, as an LNG Terminal Operator, has modified the document according to the comments received and submitted a Proposal of the rules of operation of liquified natural gas terminal for the approval of Croatian Energy Regulatory Agency, in line with the Gas Market Act (Official Gazette, No. 18/18). Managing Board of the Croatian Energy Regulatory Agency has adopted new Rules of operation of liquified natural gas terminal on session held on 21st June 2018.

NOTICE OF THE PUBLIC HEARING ON THE PROPOSAL OF THE RULES OF OPERATION OF LIQUEFIED NATURAL GAS TERMINAL

INVITATION TO PARTICIPATE IN PUBLIC HEARING IN THE PERIOD FROM MAY 28 TO JUNE 12, 2018

LNG Croatia LLC., as a terminal operator, informs the interested public about the beginning of the public consultation on the Proposal of the Rules of operation of liquefied natural gas terminal and invites energy subjects together with all the interested and professional public to submit their comments and opinions. Public consultation will be held from May 28 to June 12, 2018.

Following the market circumstances regarding the interest for the LNG terminal capacity booking by the potential terminal users in the Croatian and regional gas market, proposed document is significantly smaller than the one originally planned and expected. The main reduction reasons include, among other things, obscure prescribed capacity booking procedures, capacity allocation, maintenance of the LNG minimum operational level, allowable gas losses, rights and obligations of the terminal operator in relation to the terminal users etc. In accordance with the above, it was necessary to review the valid version of Rules of operation of liquefied natural gas terminal with the aim of clear and transparent prescribing of all shortcomings in accordance with the market practices.

Rules of operation of liquefied natural gas terminal are brought in accordance with the Article 93. of Gas Market Act (»Official Gazette « 18/18).

SECOND ROUND OF THE OPEN SEASON PROCEDURE IS BEING PROLONGED

Considering the fact that during the implementation of the non-binding phase of the Open Season process, interest in capacity booking was higher than in the first round of the binding phase of the Open Season process and requests for extension of the binding offer preparation period have been received, LNG Croatia in cooperation with Plinacro d.o.o. and FGSZ aligned a new time plan for the rest of the binding phase in the Open Season process.

Taking into account that potential users are still considering and studying new laws, regulations and other acts regulating the gas market (Rules of operation, Maritime Study, Environmental Impact Study, Proposal of the LNG Terminal Act), which are crucial for making long-term business decisions of this kind, LNG Croatia has decided to move the opening of the second round for submission of binding offers in the Open Season procedure for June 22, 2018.

By moving the opening of the second round of the procedure, users will have an additional time period for bid preparation which should lead to maximization of booked capacity and consequently in greater project competitiveness, greater security of supply in the region and lower total costs of all LNG infrastructure users.

LNG Croatia is taking this opportunity to inform users that, during the first round, requests to participate in the binding phase of the Open Season process were received from potential bidders, who were not registered in the previous phase. In order to expand the number of potential users and thereby enable project competitiveness, new participants will be able to register, in line with the new deadlines presented in the Rules for carrying out the binding phase of the Open Season procedure.

The second round for submission of binding offers will be conducted in accordance with the planned activities in Rules for carrying out the binding phase of the Open Season procedure, whereby the new time schedule for the Open Season process implementation with new deadlines will be sent to the registered applicants.

CONSULTATION WITH THE INTERESTED PUBLIC – SECOND ROUND

LNG Croatia d.o.o. informs the interested and professional public about the beginning of the public consultation relating to the proposal of the Rules of operation of liquefied natural gas terminal and to submit their comments, opinions or statements. Public consultation will be held from February 26th to March 12, 2018.

Due to the extensive changes in the latter documentation, numerous suggestions and comments received during workshops and in written, the operator has decided to carry out the next round of public consultation.

The draft of the Rules of operation of liquefied natural gas terminal was made in a way that the provisions of all legal and subordinate legislation in the gas sector in the Republic of Croatia, as well as the provisions of other relevant regulations, are taken into account.

Pursuant to the provisions of the Gas Market Act, the terminal operator shall ensure the appropriate participation of all interested parties and conduct a public consultation for a period of 15 days. The Rules of operation of liquefied natural gas terminal are provided by the terminal operator, with the consent of the Croatian Energy Regulatory Agency.

Technical characteristics of the terminal in the accompanying documentation are of an informative nature and are subject to change and will be updated upon selection of the LNG Floating, Storage and Regasification Unit.

Pursuant to the provisions of the Gas Market Act, the proposal for the Rules of operation of liquefied natural gas terminal shall be governed in particular by:

  • a description of the LNG terminal,
  • development, construction and maintenance of the LNG terminal,
  • management and supervision of the LNG terminal,
  • contractual relations and general terms of use of the LNG terminal
  • reservation and use of terminal capacity for LNG,
  • the rights and obligations of the operator of the terminal for LNG and the terminal user
  •  measurement rules and rules of allocation,
  • data disclosure and information exchange,
  • indemnity.

OFFER SUBMISSION DEADLINE PROLONGATION

We would like to inform you that due to some changes in the  Rules of Operation of Krk Liquefied Natural Gas Terminal and multiple requests from the potential applicants to extend the period for document inspection, Plinacro, FGSZ and LNG Croatia decided to postpone the start of the binding phase of the Open Season procedure. The announcement of the call for the submission of the binding bids is shifted to March 19, 2018.

Due to described changes in the time schedule, all involved parties (LNG Croatia, FGSZ and Plinacro) will prolong the period for registration until the announcement of the call for the bid submission (March 18, 2018).

The company LNG Croatia LLC announced an invitation to book the capacity of the LNG terminal on a long-term period. This is a unique opportunity for LNG suppliers, gas traders and companies already involved in wholesale of natural gas in Central Eastern and South Eastern Europe to diversify the transport route and source of natural gas via LNG terminal on the Island of Krk. To book the capacity prior to the construction of the LNG terminal, potential customers could have participated in the Open Season procedure. A twostep procedure was anticipated. The first step was a non-binding step in which a potential customer was able to submit a non-binding offer to book the capacity of the LNG terminal. Based on the received offers and total available capacity LNG Croatia LLC will give a proposal on capacity allocation. If satisfied with the capacity allocated, potential customers can proceed to the second step of the Open Season procedure and submit the binding offer. After the binding offer is accepted, customer will be able to sign a long-term contract with LNG Croatia LLC in order to finally book the previously allocated capacity.

PLANNED MARKET CONSULTATION ANNOUNCEMENT

Regarding the development of the Open Season procedure LNG Croatia is planning to start a Market consultation as the first step of the Open Season Binding Phase procedure.

It is envisaged that the Open Season Binding Phase will be performed in three stages:

  •     1st stage: Market consultation
  •     2nd stage: Preliminary Open Season
  •     3rd stage: Final Open Season

More information on the Open Season will be available on June 23 in the OPEN SEASON BINDING PHASE UPDATE PROCESS PAPER.

OPEN SEASON EXPRESSION OF INTEREST ANNOUNCEMENT 

LNG Croatia LLC has announced the successful completion of the process of final expression of interest for capacity booking for the 2015 Open Season. The final step of the binding open season process was planned to be continued through the preparation and signature of the LNG Terminal service contract with the qualified LNG Terminal users.

LNG Croatia LLC has prepared instructions for terminal users that have participated in non-binding phase on how to participate in the binding phase of Open Season procedure. Instructions could be found in the 07/2015 BINDING PHASE OPEN SEASON PROCESS PAPER.
